Fairfield's planning commission approved an amendment to zoning regulations barring new smoke, vape, and tobacco shops in all zoning districts, with the rule set to take effect on September 25. The regulation allows existing establishments to continue operating as nonconforming uses and includes exceptions for pharmacies licensed under Connecticut law, grocery stores, supermarkets, and convenience stores where tobacco products occupy less than 20 percent of the sales area, as well as businesses devoted exclusively to premium cigars. The Fairfield Police Department and the Town Plan and Zoning Department both supported the prohibition, and two letters of support were submitted. Commissioner Steven Levy, who moved to approve the amendment, said it addressed public health and safety concerns as well as nuisance conditions affecting neighboring properties. Commissioner Kathryn Braun questioned why pharmacies were exempted, but Planning Director Emmeline Harrigan explained that police had not identified businesses with accessory tobacco sales as a problem in town. Chair Tom Corsillo emphasized the distinction between dedicated tobacco businesses and other retailers, noting that police testimony indicated such businesses were the source of problems involving underage sales of tobacco and cannabis products.
