Pennsylvania vape shops closing as new Act 57 regulations take effect
Summary
Pennsylvania's new Act 57 took effect at midnight, requiring nicotine vape products to be on a state-approved list before they can be sold. Vape shops across the state, including Cool Vapes with multiple locations, are closing in response. Manufacturers must submit initial certifications for approval; selling unapproved products results in a $500 penalty per product for a first violation, $750 to $1,000 per product per day and a 14-day license suspension for a second violation within 12 months, and $1,000 to $1,500 per product per day and license revocation for a third violation. Attorney General Dave Sunday expressed sympathy for those losing jobs or businesses but emphasized his duty to enforce the law. Annual certifications for listed e-cigarettes are due by April 21 starting in 2027, but no earlier than Feb. 21 each year. The law is expected to significantly impact smoke shops that rely on selling popular, not-yet-approved vape products.
