Indiana Halts Sales of Elf Bar, Lost Mary, MR FOG and iJOY Vapes Under Foreign-Adversary Rules; Some Products Return After Compliance Filings

Indiana's Alcohol and Tobacco Commission issued a series of September notices directing tobacco certificate holders to remove vaping products marketed under Elf Bar, Lost Mary, MR FOG, iJOY, LIO and Heaven Gifts from inventory and halt sales under the state's new foreign-adversary product rules. The notices covered products from three Chinese manufacturers: Shenzhen iJOY Technology Co., Ltd., Shenzhen iMiracle Technology Co., Ltd., and Dongguan HT Technology Co., Ltd. The ATC said the products were subject to seizure by Indiana State Excise Police. Some products later regained eligibility: on September 22 the ATC listed 257 MR FOG products as lawful for sale, on September 23 it cleared 57 Lost Mary entries, and on September 24 it expanded the Lost Mary list to 77 entries after receiving evidence of compliance for 20 more products. The two revised notices contained 334 product entries, though 11 Lost Mary entries repeated earlier product names, so this does not necessarily represent 334 distinct SKUs. Unlisted MR FOG products and other Shenzhen iMiracle products, including Elf Bar and Heaven Gifts, remained barred. The actions rest on Indiana Senate Enrolled Act 185, signed March 12, 2026, effective July 1, which restricts specified e-liquids and e-liquid products tied to countries designated as foreign adversaries under 15 CFR 791.4, including China, while excluding device hardware from the definition. Exceptions are tied to FDA regulatory conditions such as marketing authorization and application-review status. 2Firsts compliance expert Kurt said potential compliance filings could involve e-liquid and ingredient origin and supply-chain records, U.S. nicotine-analog supply chains, and FDA PMTA status documentation. The ATC has not published the full documentation behind the clearances. Meanwhile, the FDA announced on September 28 plans to reassess its PMTA framework, and Indiana's Authorized E-Liquid Product List will become a key state reference after December 31, 2026, placing sourcing records, FDA filing status and state list eligibility within market-access conditions.
