Health department exempts vaping and smokeless nicotine products from bill
Summary
The South African Department of Health has decided to exempt non-combustible and smokeless tobacco products, including e-cigarettes, nicotine pouches, chewing tobacco, and snus, from the Tobacco Products and Electronic Delivery Systems Control Bill. Health Minister Aaron Motsoaledi stated that the idea of these products as harm reduction tools is based on the false premise that smokers are unable or unwilling to quit. Deputy Director-General Jeanette Hunter explained that these products differ from smoked tobacco due to fewer toxic chemicals and will be exempt from most packaging and labeling requirements, except for false advertising. Regulations will focus on protecting children by controlling product type, shape, and misleading descriptions. Concerns were raised regarding potential interference with cultural practices, particularly concerning snuff, and the department committed to ensuring its exemption. Further concerns were voiced about law enforcement capacity and border management, with the department acknowledging the need for stakeholder consultation and public participation.
