HC issues rule asking why ban on vape, e-cigarette import, sale should not be declared illegal

The High Court of Bangladesh has issued a rule questioning the constitutionality of Section 6(G) of the Smoking and Tobacco Products Usage (Control) Act, 2005, which prohibits the import, supply, and sale of vape and e-cigarettes. The court also instructed authorities to temporarily refrain from confiscating or seizing already imported vape and e-cigarettes. This order came in response to a writ petition filed by 41 traders, represented by Senior Lawyer Ahsanul Karim and Barrister HM Sanzid Siddiqui. The law currently prohibits the production, import, export, storage, advertising, promotion, sponsorship, marketing, distribution, purchase, sale, or transport of electronic nicotine delivery systems and related products, with penalties including imprisonment and fines for violations.
