France’s highest administrative court, the Council of State, has deemed Article 76 of French Polynesia’s tobacco law – which established a total ban on vaping products – illegal. The article, adopted in August and slated to take effect by 2027, was challenged by local importers and distributors who argued the ban was unjustified while cigarettes remained legal. The court sided with the importers, annulling the article and allowing French Polynesia to align its vaping regulations with those of mainland France. This means a total ban will not be implemented, but restrictions will be placed on disposable vapes, certain flavors, advertising, and sales to minors.
